1. AGREEMENT TO TERMS
By accessing or using Viral Vault (hereinafter referred to as the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (hereinafter referred to as the "Agreement"). If you disagree with any part of this Agreement, you are prohibited from accessing or using the Platform. The Platform reserves the right to modify these terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of the Platform constitutes your acceptance of such modifications.
2. DEFINITIONS
In this Agreement, unless the context requires otherwise:
"Platform" means Viral Vault and all associated services, applications, websites, and smart contracts.
"User" means any individual, entity, or organization that accesses or uses the Platform.
"SOL" means the native cryptocurrency of the Solana blockchain.
"Ticket" means a blockchain-verified entry into a raffle hosted on the Platform.
"Smart Contract" means the autonomous program deployed on the Solana blockchain that governs the operation of the Platform's raffles.
"Raffle" means a specific event hosted on the Platform where Users may purchase Tickets for a chance to win a prize.
3. ELIGIBILITY
3.1 User Requirements
To access and use the Platform, you must:
(a) Be at least eighteen (18) years of age;
(b) Possess a valid Phantom wallet or other compatible Solana wallet;
(c) Comply with all applicable local, state, national, and international laws and regulations; and
(d) Provide accurate, current, and complete information when creating an account or participating in Platform activities.
3.2 Platform Rights
The Platform expressly reserves the right to:
(a) Verify, or request verification of, any User's identity, age, and residence;
(b) Request additional documentation or information to confirm eligibility;
(c) Refuse service to any User at its sole discretion; and
(d) Cancel any raffle entries if eligibility requirements are not met or if the Platform has reason to believe that a User has violated this Agreement.
4. RAFFLE ENTRY
4.1 Ticket Purchase
(a) All raffle Tickets require payment in SOL at the specified price.
(b) All transactions conducted on the Platform are final and non-reversible upon confirmation on the blockchain.
(c) Users are responsible for all gas fees associated with blockchain transactions.
(d) Unless otherwise specified in a particular raffle, there is no maximum limit to the number of Tickets a User may purchase.
(e) The Platform does not guarantee the value of SOL and is not responsible for any fluctuations in cryptocurrency value.
4.2 Entry Confirmation
(a) Raffle entries are valid only when they have been confirmed and recorded on the Solana blockchain.
(b) Users are solely responsible for ensuring their transactions are properly completed.
(c) The Platform shall not be liable for any failed transactions, regardless of cause, including but not limited to network congestion, wallet errors, or blockchain issues.
(d) Users may verify their entries through blockchain explorers or through the Platform's interface when available.
5. WINNER SELECTION
5.1 Selection Process
(a) Winners shall be selected through the Platform's Smart Contract using a verifiably random process.
(b) Winner selection will only occur after the specified minimum threshold of Ticket sales has been met for a particular raffle.
(c) All selection results are verifiable on the Solana blockchain and are final once recorded.
(d) The Platform's decisions regarding the winner selection process are final and binding.
5.2 Winner Notification
(a) Winners will be announced on the Platform and may be notified through available communication channels.
(b) Winners have forty-eight (48) hours from the time of announcement to initiate the claim process.
(c) As part of the claim process, winners must provide their X-handle (formerly Twitter) through the Platform's encrypted process.
(d) Winners must contact the Platform through specified channels for verification.
(e) Winners may be required to provide additional verification documents to claim their prize.
(f) If a winner fails to respond within the specified timeframe, the Platform reserves the right to select an alternate winner or to handle the prize as it deems appropriate in accordance with applicable laws.
6. PRIZE CLAIMS
6.1 Requirements
To claim a prize, winners must provide:
(a) Valid government-issued identification;
(b) Proof of ownership of the wallet used to purchase the winning Ticket;
(c) Their X-handle through the Platform's encrypted submission process;
(d) Shipping information for physical prizes; and
(e) Any customs documentation that may be required for international shipments.
6.2 Timeframes
(a) Winners have forty-eight (48) hours to initiate the claim process from the time of announcement.
(b) Winners have seven (7) days to complete the verification process once initiated.
(c) Winners have thirty (30) days to accept delivery of physical prizes.
(d) The Platform may, at its sole discretion, extend these timeframes in exceptional circumstances.
(e) Failure to comply with these timeframes may result in forfeiture of the prize.
7. REFERRAL PROGRAM
7.1 Eligibility
(a) All Users are eligible to participate in the Platform's referral program.
(b) Only successful raffles, defined as those that meet the minimum threshold and complete the winner selection process, count towards referral payouts and tracking.
7.2 Conditions
(a) Referring Users shall receive a ten percent (10%) referral bonus on all successful referrals at all times, unless otherwise specified.
(b) All referral payouts will be made in SOL, and therefore the value might differ due to market fluctuations.
(c) Network fees associated with referral payouts will not be covered by the Platform.
(d) The Platform reserves the right to modify the referral program at any time.
8. FREE GIVEAWAYS AND COMMUNITY RAFFLES
8.1 Overview and Purpose
(a) The Platform may, at its sole discretion, offer free giveaways and community raffles (hereinafter referred to as "Free Raffles") to reward active community participation.
(b) Previous raffle entries are tracked by the Platform and count toward Free Raffle eligibility as described in this section.
(c) Free Raffles are offered as a goodwill gesture by the Platform and do not constitute a contractual obligation to conduct such raffles indefinitely.
8.2 Eligibility Requirements
(a) To be eligible for Free Raffles, Users must have participated regularly in official paid raffles on the Platform.
(b) Eligibility status may reset if a User has participated in a previous Free Raffle, as determined by the Platform.
(c) There is no minimum entry requirement per individual raffle to qualify for Free Raffle eligibility.
(d) All previous entries count retroactively toward Free Raffle eligibility from the Platform's launch date.
(e) The Platform will announce specific eligibility thresholds for each Free Raffle based on the value of the giveaway item, which may require Users to have accumulated a specified number of previously acquired tickets.
8.3 Implementation and Schedule
(a) Historical entry tracking begins at the Platform's official launch date.
(b) Free Raffles will commence at the Platform's discretion and will be announced through official communication channels.
(c) An official schedule for Free Raffles will be announced through the Platform's communication channels when established.
8.4 Benefits and Prize Pool
(a) Free Raffles require zero entry cost from eligible Users, though Users remain responsible for any blockchain transaction fees.
(b) Free Raffles provide the same winning odds as paid raffles, proportional to entry allocation.
(c) Prizes awarded through Free Raffles have full stated value and authenticity.
(d) The prize pool for Free Raffles may include, but is not limited to: (i) Luxury watches; (ii) Designer jewelry; (iii) Limited edition items; and (iv) Exclusive products otherwise unavailable through regular raffles.
8.5 Terms and Conditions Specific to Free Raffles
(a) Free Raffle entries cannot be combined with paid entries in the same raffle.
(b) Winners of Free Raffles must claim their prizes within the standard timeframe specified in Section 6.2 of this Agreement; failure to do so may result in selection of an alternate winner.
(c) For Free Raffle prizes, shipping costs must be covered by the winner, regardless of location.
(d) Winners of Free Raffles are subject to the same verification requirements as winners of paid raffles.
8.6 Modification and Termination
(a) The Platform expressly reserves the right to modify the terms, frequency, eligibility requirements, or any other aspect of Free Raffles at any time without prior notice.
(b) The Platform expressly reserves the right to discontinue Free Raffles at any time, for any reason, at its sole discretion.
(c) Discontinuation of Free Raffles shall not affect the validity of this Agreement or any other services provided by the Platform.
9. SHIPPING & DELIVERY
9.1 Domestic (USA)
For winners located within the United States:
(a) FedEx shipping will be provided at no additional cost to the winner.
(b) Full insurance coverage will be included for the declared value of the prize.
(c) Signature will be required upon delivery.
(d) Standard delivery typically takes three to five (3-5) business days, though the Platform does not guarantee specific delivery timeframes.
9.2 International
For winners located outside the United States:
(a) Winners are responsible for all shipping costs.
(b) Winners are responsible for all import duties, taxes, and customs fees.
(c) Winners must comply with all local regulations regarding the importation of prizes.
(d) The Platform is not responsible for delays or confiscations by customs authorities.
10. REFUNDS
10.1 Eligibility
Refunds may be issued in the following circumstances:
(a) When a raffle does not meet its minimum threshold for ticket sales and is consequently cancelled;
(b) When the Platform experiences technical issues that materially affect a User's participation;
(c) When a raffle is cancelled by the Platform for any reason; or
(d) When a transaction fails but SOL is deducted from a User's wallet.
10.2 Process
To receive a refund:
(a) Users must submit a claim through the Platform's designated channels.
(b) All refunds are subject to gas fees, which may be deducted from the refund amount.
(c) Refunds will only be issued to the original wallet used for the transaction.
(d) Refund claims must be submitted within a reasonable time period as determined by the Platform.
11. PLATFORM OPERATIONS
11.1 Service Availability
(a) The Platform may experience downtime for maintenance, upgrades, or due to technical issues.
(b) Maintenance may be performed without prior notice to Users.
(c) The Platform does not guarantee continuous, uninterrupted, or secure access to its services.
(d) The Platform shall not be liable for any downtime, delays, or service unavailability due to blockchain network issues, internet connectivity problems, or factors beyond its reasonable control.
11.2 Smart Contract
(a) The Platform's Smart Contract code is available for review by Users.
(b) The Smart Contract operates autonomously according to its programmed parameters.
(c) Once deployed, the Smart Contract cannot be modified, except through governance mechanisms if implemented.
(d) The Smart Contract is subject to the limitations and potential vulnerabilities inherent in blockchain technology.
12. USER CONDUCT
Users expressly agree not to:
(a) Manipulate or attempt to manipulate any aspect of the Platform or its mechanics;
(b) Use automated systems, bots, scripts, or any similar methods to purchase Tickets or interact with the Platform;
(c) Provide false, misleading, or inaccurate information to the Platform or other Users;
(d) Attempt to bypass or compromise the Platform's security measures or blockchain integrity;
(e) Engage in any activity that disrupts or interferes with the proper functioning of the Platform;
(f) Violate any applicable laws or regulations while using the Platform; or
(g) Assist or enable others to engage in any of the prohibited activities listed above.
13. PRIVACY & DATA
13.1 Collection
The Platform may collect and store the following information:
(a) Wallet addresses and transaction data;
(b) Shipping information provided for prize delivery;
(c) Verification documents submitted by winners; and
(d) Communication records between Users and the Platform.
13.2 Usage
The information collected may be used for:
(a) Facilitating prize delivery and verification;
(b) Platform operations and improvements;
(c) Compliance with legal obligations; and
(d) Security measures to protect the Platform and its Users.
The Platform is committed to protecting User data and will only use collected information for the stated purposes and in accordance with applicable privacy laws.
14. INTELLECTUAL PROPERTY
14.1 Ownership
The Platform retains all rights, title, and interest in and to:
(a) The Platform name, branding, logos, and trademarks;
(b) Website content, designs, and interfaces;
(c) Smart Contract code and related technical implementations; and
(d) All marketing materials, documentation, and other content produced by the Platform.
14.2 Restrictions
Users are expressly prohibited from:
(a) Using the Platform's intellectual property without prior written authorization;
(b) Reproducing, copying, or duplicating any content from the Platform except as expressly permitted;
(c) Modifying, adapting, or creating derivative works based on the Platform's intellectual property; and
(d) Distributing, licensing, selling, or otherwise commercializing any Platform content or code.
15. LIABILITY
15.1 Limitation of Liability
The Platform shall not be liable for:
(a) Any issues related to the Solana network or blockchain functionality;
(b) Wallet problems, including but not limited to lost private keys or compromised wallets;
(c) Failed transactions, regardless of cause;
(d) Shipping delays, customs issues, or delivery problems with prizes; or
(e) Any force majeure events, including but not limited to natural disasters, civil unrest, war, or regulatory actions.
15.2 Damages Limitation
In no event shall the Platform be liable for:
(a) Any amount exceeding the entry amount paid by a User for the specific raffle in question;
(b) Any consequential, incidental, indirect, special, punitive, or exemplary damages;
(c) Any lost profits, lost revenue, lost business opportunities, or similar losses; or
(d) Any damages resulting from the use or inability to use the Platform or its services.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
16. DISPUTE RESOLUTION
16.1 Process
In the event of any dispute, controversy, or claim arising out of or relating to this Agreement:
(a) The parties shall first attempt to resolve the dispute through good faith negotiation.
(b) Any party seeking to initiate dispute resolution shall provide written notice to the other party describing the nature of the dispute.
(c) The parties shall have thirty (30) days from the receipt of such notice to attempt to resolve the dispute.
(d) If the dispute is not resolved within this period, either party may submit the dispute to binding arbitration.
16.2 Jurisdiction and Venue
(a) This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.
(b) Any arbitration shall be conducted in [Jurisdiction] in accordance with the rules of [Arbitration Association].
(c) Users expressly waive their right to participate in a class action lawsuit or class-wide arbitration.
(d) Any proceedings to resolve or litigate any dispute shall be conducted solely on an individual basis.
17. MODIFICATIONS
17.1 Terms Modifications
(a) The Platform reserves the right to modify, amend, or change this Agreement at any time.
(b) Notice of material changes will be provided through the Platform's website or other communication channels.
(c) Continued use of the Platform after any modifications constitutes acceptance of the modified Agreement.
(d) Prior versions of the Agreement will be archived and may be made available upon request.
17.2 Platform Modifications
The Platform reserves the right to:
(a) Change, modify, or remove features and functionality;
(b) Alter the services provided;
(c) Modify raffle parameters, procedures, or requirements; and
(d) Provide notice of such changes when practical, but may implement changes without notice when necessary.
18. TERMINATION
18.1 Termination by Platform
The Platform may terminate or suspend a User's access to the Platform at any time for:
(a) Violation of this Agreement;
(b) Suspicious or potentially fraudulent activity;
(c) Compliance with legal requirements or governmental requests; or
(d) Any other reason at the Platform's sole discretion.
18.2 Effect of Termination
Upon termination or suspension:
(a) The User's access to the Platform may be removed;
(b) Pending raffle entries may be cancelled;
(c) Refunds may be issued at the Platform's discretion, if applicable; and
(d) User data may be retained as required by law or as necessary for legitimate business purposes.

20. SEVERABILITY
If any provision of this Agreement is found to be unenforceable or invalid:
(a) Such provision shall be modified to the minimum extent necessary to make it valid and enforceable.
(b) The remainder of the Agreement shall remain in full force and effect.
(c) The spirit and intent of the original provision shall be maintained to the greatest extent possible.
(d) All provisions shall be interpreted in good faith to effectuate the purposes of this Agreement.
BY USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
